1. Introduction
Welcome to DTM Income Tax (“we,” “us,” or “our”). These Terms and Conditions govern your use of our website and the tax preparation, consultation, and filing services we provide. By engaging our services or using our website, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Description of Services
DTM Income Tax provides tax preparation, electronic filing (e-filing), and related tax consulting services. We will prepare your federal and state tax returns based on the information, documentation, and representations you provide to us.
We do not audit, verify, or independently confirm the accuracy of the information you submit. We rely on you to provide complete and truthful information.
3. Client Responsibilities
By using our services, you agree to the following responsibilities:
- Accuracy of Information: You are ultimately responsible for the accuracy and completeness of your tax returns. You confirm that all income, expenses, deductions, and credits reported are true and supported by proper documentation.
- Timely Delivery: You must provide all necessary tax documents (W-2s, 1099s, receipts, etc.) in a timely manner to allow adequate time for preparation and filing before the tax deadlines.
- Record Retention: You are responsible for keeping copies of all documents, canceled checks, and other data that support your reported income and deductions. We recommend retaining these records for at least seven (7) years.
- Review of Returns: You agree to carefully review your tax returns before signing Form 8879 (IRS e-file Signature Authorization) or any equivalent state forms.
4. SMS/Text Messaging and Communications
By providing your phone number and opting in via our website forms, you consent to receive communications from DTM Income Tax:
- Transactional Messages: You consent to receive messages related to your account, appointments, document requests, tax filing status, and other service-related updates.
- Marketing Messages: If you explicitly opt-in, you consent to receive promotional messages, tax deadline reminders, and special offers.
Opting Out: Message frequency may vary. Message and data rates may apply. You may opt out of receiving SMS messages at any time by replying “STOP” to any of our text messages. For assistance, reply “HELP”.
5. Fees and Payment Terms
Our fees for tax preparation and related services are based on the complexity of your return and the forms required. An estimated fee can be provided upon request prior to the commencement of services.
All fees are due and payable in full upon completion of the tax preparation process and prior to the electronic filing or release of your tax return, unless a bank product (e.g., deducting fees directly from your refund) has been formally agreed upon and approved.
6. Limitation of Liability
DTM Income Tax will exercise due professional care in preparing your returns. However, we cannot guarantee that the IRS or state tax authorities will not audit your return, disallow certain deductions, or assess penalties.
- We are not liable for any additional taxes, penalties, or interest resulting from inaccurate, missing, or incomplete information provided by you.
- In the event of an error strictly caused by DTM Income Tax, our liability shall be limited to the reimbursement of any direct penalties assessed by the taxing authority due to that specific error. We will not be responsible for the actual tax liability or interest accrued.
7. IRS and State Audits
Your returns may be selected for review or audit by taxing authorities. In the event of an audit or inquiry, we are available to assist or represent you; however, such representation is not included in the standard tax preparation fee and will be billed separately unless a prior audit protection agreement was purchased.
8. Privacy and Data Security
We treat your financial and personal data with the highest level of confidentiality, in compliance with federal laws regarding tax preparers. We will not disclose your personal information to third parties without your explicit written consent, except as required by law to electronically file your return. For more details, please review our Privacy Policy.
9. Termination of Services
We reserve the right to withdraw from our engagement and refuse service if you fail to provide necessary information, provide fraudulent or misleading information, or fail to pay our fees.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the state in which DTM Income Tax is headquartered, without regard to its conflict of law provisions.
